Terms
Last updated 2 November 2026. These are the terms on which we sell and licence Cuemark.
Who we are
Cuemark Email us about anything here — a person reads it.
Trying Cuemark
Cuemark is free to download and try with an account. Without a licence it opens the two example scripts it comes with, for as long as you like.
Your licence
- A licence lets you use Cuemark for one year from the day you buy it, on up to two computers at a time. You can move it between computers whenever you like, from your account page or the app.
- It is for you, or your organisation, to use in your own work. Please do not share your key, resell it, or use one licence on more computers than it covers.
- You may not copy, modify or resell the app, or take it apart to make something that competes with it, except where the law allows you to regardless.
- Updates to Cuemark are included while your licence runs.
- Nothing is taken from your card again when the year ends. To carry on, buy another year. Your shows and markup are files on your own computer and are always yours, licence or not.
Price and payment
The price is shown on the buy page and includes VAT where it applies. Payment is taken by Stripe when you buy; we never see your card details. Your licence key is emailed to you, and appears on your account page, as soon as the payment clears.
Your right to cancel
When you buy something online you usually have 14 days to change your mind. Because a licence is delivered to you straight away, we ask at checkout whether you want it now and understand that, once it has been supplied, that 14-day right to cancel ends. We only take your order if you agree, and we confirm it in the email that carries your key. If your payment has not cleared and no key has been sent, you can still cancel by emailing us.
If something is wrong
Cuemark must work as described. If it does not, tell us: we will fix it or give you a version that works, and if we cannot do that within a reasonable time, we will refund you in full or in part. This is in addition to your legal rights under the Consumer Rights Act 2015, which these terms do not take away. If Cuemark itself damages your computer or other software because we did not take reasonable care, we will repair the damage or pay you for it.
Please keep copies of your show files: Cuemark keeps automatic backups on your computer, but your computer can fail like any other.
Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or not taking reasonable care. We are not responsible for loss or damage that was not foreseeable. If you use Cuemark for business, we are not responsible for loss of profit, business, or business opportunity, and our total responsibility to you is limited to what you paid for your licence. Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
Ending a licence
We may end a licence if a key has been shared or resold, or a payment for it is reversed; we will tell you first where we can. Ending a licence never touches your show files.
Scripts you share
- A script you open in Cuemark stays on your computer. It only goes anywhere if you share it with your company through Cuemark Connect, or send it to a cast member’s phone in Cuemark Cast.
- You may only share a script you have the right to share with the people you send it to: a performance licence that lets you give copies to your company, or permission from the writer, publisher or other rights holder. By setting up sharing or sending a script in Cuemark, you confirm that you have permission from the rights holder, or a licence, to share it with your company.
- You are responsible for the scripts you share and for who you share them with. We do not check what is shared, and we cannot: a script is encrypted on your computer before it is sent, and only the people you let into the production can open it.
- Sharing a script does not give us any rights in it. We only carry it to the people you choose.
- If a rights holder tells us a script has been shared without permission, we may close that production to new copies, and we may end the licence of anybody who does it again.
Your data
How we use the little data we hold is on the privacy page.
Changes to these terms
We may update these terms. The terms that apply to your licence are the ones on this page on the day you bought it.
The law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can bring a claim in your local courts too. If you have a complaint, please email us first — we would far rather put it right.
